The “Win Up to $5000 Off your Dream Wedding” (“The Promotion”) is a sweepstakes which allows participants to enter for a chance to win up to $5000.00 off their wedding , pursuant to these official rules (the “Official Rules”), which are available online at www.feastivities.ca.

By taking part in this Promotion you accept and agree to be bound by these Official Rules and agree that all decisions of 43 NORTH RESTAURANT GROUP INC.  are final and binding. The Promotion is subject to all applicable federal, provincial and local laws and regulations and is void where prohibited by law. These Official Rules apply only to this Promotion and not to any other promotions, contests, or sweepstakes by 43 NORTH RESTAURANT GROUP INC..  

PROMOTION PERIOD: The Promotion begins on February 1, 2024 at 9:00AM EST and ends on March 16, 2024 at 04:00:00 PM EST (the “Promotion Period”). 

ELIGIBILITY, RESIDENCY AND AGE: The Promotion is only open to legal residents of Ontario, Canada, who are at least eighteen (18) years of age at the time of entry (each, an “Entrant”). Employees, officers and directors, and the household and immediate family members and/or those with whom such employees, officers and directors are domiciled, of 43 NORTH RESTAURANT GROUP INC. and their respective parent companies, subsidiaries, franchisees, affiliates, advertising and promotion agencies (collectively, “Sweepstakes Entities”) are not eligible to enter or win. For the purpose of these Official Rules, “household members” means those people who share the same residence and/or mailing address at least three months per year with one or more Sweepstakes Entities and “immediate family members” means any parent, spouse, sibling or child and their respective spouses. Sponsor reserves the right to verify the eligibility of the winner. The contest is subject to all applicable provincial, federal, and local laws and regulations. Void where prohibited or if the order is canceled/invalid at the time of the announcement.

Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of 43 North Restaurant Group Inc. as final and binding as it relates to the content. The contest is subject to all applicable federal, provincial and local laws.

How to Enter: RSVP to “The One: Bridal Showcase” through “www.feastivities.ca” and sign in on the guest list by attending the event on March 16, 2024 happening between 12:00:00 PM EST to 04:00:00 PM EST at the Ovation Ballroom, 1311 Egerter Road, Port Robinson, ON, L0S 1K0.

Prize: One (1) winner can win up to an approximate aggregate retail value of $5,000 CAD off their wedding with 43 North Restaurant Group: 

• $5000 CAD Value is based on choosing the Diamond tier wedding package, with a minimum of 150 guests.
• Value of the promotional offer will be adjusted based on the tier of the wedding package selected and the number of  wedding guests.

Prize must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at 43 NORTH RESTAURANT GROUP INC.’s sole option. 43 NORTH RESTAURANT GROUP INC. reserves the right, in their sole and absolute discretion, to substitute the Prize or a component thereof with a prize of equal or greater value, including, without limitation, but at 43 NORTH RESTAURANT GROUP INC.’s sole and absolute discretion, a cash award.

Odds: The odds of winning depend on the number of eligible entries received.

Prize Draw: A random draw for the prize winner (the “Prize Winner”) will take place on March 16, 2024 in Port Robinson, Ontario from all eligible entries received during the Promotion Period. An Entry selected will be eligible to win one (1) Prize. The odds of winning a Prize will depend on the total number of eligible Entries received during the Promotion Period. In the event of any error of any kind whatsoever, more potential winners are selected than specified in these Official Rules, the Sponsor reserves the right to hold a random draw amongst all potential prize claimants to award the correct number of Prizes.

ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Winner Selection and Notification: The selected Entrants for the Prizes will be contacted via email or by telephone by a representative of the Sweepstakes Entities by March 22, 2024. If the potential winner cannot be reached OR in the event a potential winner does not accept a Prize or fails to comply with these rules and requirements within two (2) business days of being contacted by email or phone, the Prize will be forfeited. Upon Prize forfeiture, no compensation will be given and the Sponsor will have sole discretion to randomly select another potential winner. Before being declared a Prize Winner, the selected Entrant will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question and will also be required to sign, a Declaration and Release Form (the “Release Form”) stating that he/she has read, understood and complied with these Official Rules (including the eligibility requirements); grants all consents required as contemplated in these Official Rules; authorizes 43 NORTH RESTAURANT GROUP INC. and their designees and assigns to use the winner’s name, voice, city/province of residence, photos, video or film clips, and/or other visual likeness for advertising and/or trade purposes and/or for any other purpose in any media or format now or hereafter known without further compensation (financial or otherwise), permission or notification; and releases the Releasees and the supplier and/or Prize Provider from any and all liability of any kind arising out of the Prize Winner’s participation in this Promotion and receipt and use of the Prize. If the selected Entrant fails to correctly answer the mathematical skill-testing question, fails to execute and return the Release Form within the required time period of two (2) business days, is otherwise not in compliance with the Official Rules, or is unable or unwilling to comply with these Official Rules, the selected Entrant will be deemed ineligible and will forfeit his/her Prize. A new potential winner will then be selected from all remaining eligible Entries in accordance with these Official Rules. All decisions of the Sponsor with respect to any aspect of this Promotion, including without limitation, the eligibility of Entries, are final and binding on all Entrants in all matters as they relate to this Promotion. 

Rights Granted by you: By entering this content you understand that 43 North Restaurant Group Inc., or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner’s name, advertising, public relations and promotional purposes without any further compensation.

Terms: 43 North Restaurant Group Inc. reserves the right, in its sole discretion to cancel, terminate, modify or suspend the contest should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the contest. In such case, 43 North Restaurant Group Inc. may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by 43 North Restaurant Group Inc. The aforementioned companies reserve the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the contest or website or violates these Terms & Conditions Napoleon has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering.

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, 43 North Restaurant Group Inc. reserves the right to seek damages from any such person to the fullest extent permitted by law.

Limitation of Liability: By entering you agree to release and hold harmless 43 North Restaurant Group Inc. and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

PERSONAL INFORMATION PRIVACY: Personal information of Entrants will (i) be held by the Sponsor; (ii) be used for, and accessible only to employees directly involved in the Promotion, internal analysis by Sweepstakes Entities and its affiliates, agents and advertising and promotional agencies; and, (iii) not be disclosed to other third parties. By entering this Promotion, each Entrant consents to the Sweepstakes Entities and their agent’s collection, use and disclosure of Entry information for the purposes of administering this Promotion. 

INTELLECTUAL PROPERTY: All intellectual property, including but not limited to trademarks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations that appear on the Sponsor’s websites and other sites in connection with this Promotion, are owned or controlled by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited. 

JURISDICTION OF LAWS: THIS CONTEST IS GOVERNED BY THE LAWS OF CANADA AND ONTARIO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this giveaway, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Ontario having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, and participant further waives all rights to have damages multiplied or increased.
